Population vs Representation: The Core Debate of Delimitation in India

Abstract :
This research paper is about the Delimitation Act 2026 in India for seat allocation in the Indian parliament. This research paper clearly explains the Delimitation Act and the historical background of the Delimitation in India and elucidates the procedure and process of the Delimitation in India. It gives the idea about the SC and ST reservation in the parliament for their development and giving the equal rights for all the categories of the people in India to ensure the equality. This research paper mainly focuses on the effect of the Delimitation in the state Tamil Nadu and what are the loses faced by the state and describes the challenges and issues in the Delimitation. This research examines the legal and constitutional framework governing delimitation, its historical evolution, and its likely impact on political representation, with particular emphasis on Tamil Nadu. While delimitation aims to uphold the democratic principle of equal representation by allocating seats according to population, it also raises concerns about the potential disadvantage faced by states that have successfully implemented population control measures. The study argues that a purely population-based approach may reduce the parliamentary representation of southern states, particularly Tamil Nadu, despite their achievements in population stabilization, economic development, and social welfare.
The research adopts both doctrinal and non-doctrinal methods. The doctrinal analysis examines constitutional provisions, the Delimitation Act, 2002, judicial and statutory materials, and relevant scholarly literature, while the non-doctrinal component is based on a survey of 131 respondents from Tamil Nadu using percentage analysis. The findings reveal that a majority of respondents believe the proposed delimitation may reduce the political influence of states that have effectively controlled population growth and may also intensify regional political differences, thereby affecting the spirit of cooperative federalism and national unity. The study further highlights the need to consider additional criteria, such as development indicators, governance performance, and demographic responsibility, alongside population while allocating parliamentary seats. It concludes that a balanced delimitation framework is essential to preserve constitutional equality, strengthen federalism, and ensure fair political representation without penalising states for their developmental achievements.
