Men Facing False Section 354 IPC Cases: Unseen Struggles and Social Consequences

Abstract :
False accusations within criminal law have emerged as a critical issue in contemporary legal and social discourse, particularly in the context of gender-related offences. Section 354 of the Indian Penal Code (IPC), enacted to protect women from assault or criminal force intended to outrage their modesty, plays a pivotal role in safeguarding bodily integrity and personal dignity. The provision covers a wide range of behaviours, including physical contact, sexual harassment and other acts that demean or exploit women, reflecting the legislature’s commitment to combating gender-based violence.
However, the broad interpretative scope of Section 354 has also given rise to concerns regarding its potential misuse. Instances of false allegations—driven by motives such as personal disputes, retaliation, coercion or financial gain—pose significant challenges to the justice system. Such misuse not only undermines the credibility of genuine victims but also inflicts severe social, emotional, psychological and legal consequences on the falsely accused. The resulting hardships often include reputational damage, mental trauma and prolonged legal battles.
This study underscores the need for a balanced legal framework that continues to protect women effectively while also ensuring safeguards against wrongful criminalization. A nuanced approach—grounded in fairness, evidence-based procedures and judicial scrutiny—is essential to maintaining public trust in the justice system and advancing the principles of equality and justice for all.
